Kevin has had an active practice as an arbitrator, adjudicator and counsel since being called to the Malaysian Bar in 1998. He has broad experience in civil and commercial litigation, domestic and international arbitration. 

He represents clients in trial and appellate advocacy and as counsel in arbitration in a broad range of disputes including construction and infrastructure disputes, construction adjudication, corporate and commercial disputes, shareholder conflict, contractual and civil claims. His principal area of practice is in building contract, construction and infrastructure disputes. 

Kevin is a member of the AIAC Panel of Arbitrators and Adjudicators and is an accredited adjudicator under Malaysia’s Construction Industry Payment and Adjudication Act 2012. 

He is regularly appointed as sole arbitrator, party-nominated arbitrator in three-member tribunals and presiding arbitrator as well as adjudicator in construction disputes. 

In his early years, Kevin was an associate in the tax compliance practice and associate consultant in the consulting practice (liquidation and receivership) of two Big Four consulting firms. 

Kevin holds a LL.B. (Hons) from the University of London and an LL.M. (Hons) from the University of Malaya.

Market Leading Experience
  • Represented the employer in a dispute arising from a contract for the construction of a high-end residential project in Kuala Lumpur involving multiple law firms representing both parties. Kevin’s led the defence relating to the main contractor’s claim for payment for work done under the contract. 
  • Represented the main contractor in a dispute in respect of a contract for the design and refurbishment of a multi-storey hotel in Kuala Lumpur. Disputes were in respect of claims for work done, extension of time, prolongation loss and expense, termination of the contract, defect damages and liquidated damages (AIAC, PAM). 
  • Represented the main contractor in a dispute arising from a contract for the establishment of a double circuit power transmission line in Malaysia. Disputes included claims for payment for main scope and additional work, release of retained payment, claims for extension of time, delay loss and expense, liquidated damages (FIDIC, Ad Hoc). 
  • Represented the main contractor in a dispute arising from a contract for the refurbishment of a multi-storey block of a private hospital in Kuala Lumpur. Disputes included disputes claims for payment for main scope and additional work, multi-fold applications for extension of time, clashes between architectural and engineering designs, claims for loss and expense (PAM, Ad Hoc). 
  • Represented the main contractor in a court dispute relating to the termination of a contract for the design, construction, testing and commissioning monorail trains in a project in Kuala Lumpur. 
  • Represented the main contractor in a dispute relating to completion and fulfilment of commercial terms of a contract for the design, construction, testing and commissioning of monorail trains in a project in Kuala Lumpur (FIDIC, Ad Hoc). 
  • Represented the main contractor in a dispute arising from a contract for the design, installation of electrical systems for monorail train projects in Kuala Lumpur and Mumbai (SIAC, Singapore seated). 
  • Represented the purchaser in a in respect of a claim for damages arising from breach of a coal supply agreement. Dispute was in respect of the delivery and quality of the supply of coal (ICC). 
  • Represented the subcontractor in a dispute arising from a contract for the design, supply and installation of a CBD wide, closed-circuit camera system (AIAC). 
  • Represented the subcontractor in a dispute arising from an EPC contract for the installation and commissioning of an export gas compressor on an offshore platform. Dispute (ICC). 
  • Represented the contractor in a dispute arising from a Topside Major Maintenance contract. Disputes included claims for payment for completed work, termination of the contract and for loss of profit arising from early termination of the contract (Ad Hoc).
  • Represented the owner in a dispute arising from the construction of a Lecture Theatre and a Sports Complex for a private college (now university college) in Kuala Lumpur. Disputes included claims for payment for completed work, claims for extensions of time and delay damages (PAM). 
  • Represented the subcontractor in a dispute arising a contract for pipe insulation work during the construction and revamp of a large ammonia plant in Malaysia (Ad Hoc). 
  • Represented the main contractor for infrastructure works in a dispute arising from a contract for the design and construction of a fire water loop system at the KLIA airport (Ad Hoc). 
  • Represented the hotel manager in a dispute arising from a hotel management agreement. Disputes included termination of the hotel management agreement and outstanding fee payment (Ad Hoc). 
  • Represented an owner of a large chemical storage facility in Malaysia in a claim by vessel owners for loss of product due to rupture damage of a liquid cargo tank on a chemical tanker during nitrogen blanketing. 
  • Represented a developer in a claim for damage to a shopping centre arising from earth settlement on adjacent land alleged to be caused by a deflecting diaphragm wall during sub-structure construction.
