Our History

Our firm’s civil aviation practice began in the late 1980’s with the assistance of one of our founding partners, Dato Mohammed Adnan B. Datuk Shuaib. We were one of the first firms to venture into this area of practice and acted for foreign aircraft lessors and financiers to close civil aviation deals in Malaysia.

Our Expertise

We are familiar with the regulatory processes and practices of the Civil Aviation Authority of Malaysia and are regularly engaged to advise on the Malaysian law aspects of the sale and purchase of aircraft and the due conveyance and registration thereof on the local civil aviation register. We have advised domestic and international clients in relation to registration matters such as the change of ownership of aircraft, leases, mortgages on aircraft, and the irrevocable deregistration and export request authorisation with the Civil Aviation Authority of Malaysia.

In addition, our team has experience in advising on establishing structures for the raising of finance by the sale and leaseback of aircraft, typically through Malaysia’s mid-shore financial centre in Labuan. We have been involved in a number of sizable aviation financing transactions, some involving the participation of the export-import banks of the countries where the aircraft were manufactured.

Our Deal Experience:

Some of our more notable transactions are as follows:

  • Acted as Malaysian counsel in the purchase financing and leaseback of 18 Boeing 737-400 aircraft by a Labuan special purpose vehicle

  • Assisted an international aviation service provider in structuring the availability of aviation rotable spare parts in 3 countries in South East Asia

  • Assisted a renowned foreign export credit agency in facilitating the financing for the purchase of various aircraft by Malaysian air operators
